Welcome to the https://training-indonesia.org (“Site”), owned and operated in Indonesia by the German-Indonesian Chamber of Industry and Commerce (“EKONID”). The Site is dedicated to creating a dynamic, user-friendly platform where professional trainers can offer industry-relevant and quality-controlled trainings to support the continuous development of human capital in Indonesia.

Please review these Terms of Use (“Terms”) thoroughly as they serve an enforceable contract between you:

1. An individual user or a single entity, who visits the Site (“Users”, “User”);
2. An individual, business or legal entity who provides training courses (“Training Providers”, “Training Provider”); and
3. An individual who enrolls in a training course or courses offered by Training Provider on the Site (“Participant”, “Participants”)

and EKONID regarding the use of the Site.

By accessing the Site, you agree to these Terms. Additionally, our practices regarding the processing of personal data are outlined in our Privacy Policy The Training Provider Terms, Privacy Policy, and any written agreement between you and EKONID related to your use of the Site are incorporated by reference into these Terms.

EKONID may change, add, or remove portions of these Terms at any time. Such changes shall become effective immediately upon posting. It is the User, Participants and Training Provider’s responsibility to review these Terms prior to each use of the Site.

 

1. Account

To engage in most activities on our Site including purchasing and accessing training courses or subscription plan (“Services”) you are required to create an account. When setting up and maintaining your account, you must provide and continually update accurate and complete information, including a valid email address.

You bear full responsibility for your account and any activities that occur under it. This includes any harm or damage that may result from unauthorized use of your account. It is important that you safeguard your password and take necessary precautions to prevent unauthorized access. You are prohibited from transferring your account to another individual or from using another person’s account. Should you contact us to request access to an account, we will only grant such access upon verification that you are the rightful owner of the account. In the unfortunate event of the account owner is death, the account will be closed.

You may not share your account login credentials with anyone else. EKONID will not intervene in disputes arising between Participants or Training Providers who have shared account login credentials. It is your responsibility to notify us immediately if you become aware of any unauthorized use of your account or if you suspect any breach of account security. Please contact admin@training-indonesia.org promptly in such cases. To verify your identity as the account owner, we may request additional information from you.

To create an account on the Site and utilize our Services, Users and Training Providers must be at least 18 years of age. If you are younger than 18 but meet the age requirement for consent to use online services as specified by your jurisdiction (for example, 13 years old in the United States or 16 years old in Ireland), you are not permitted to create an account independently. Instead, we encourage you to have a parent or guardian establish an account on your behalf and assist you in accessing suitable content.

If you are below this age of consent for online services, you are prohibited from creating an account on the Site. Should we discover that an account has been created in violation of these eligibility requirements, we reserve the right to terminate the account.

 

2. Payments and Refunds

 

1. Payments

By making a purchase on the Site, you agree to pay the applicable fees for the subscription plan and training courses (“Subscription Fee” and “Training Fee”) you acquire. To process the payment, you authorize us to charge your debit or credit card or process other payment methods through our payment service provider, Xendit, to facilitate this transaction.

When completing a purchase, you must ensure that you use a valid and authorized payment method.

 

 

2. Refunds

A refund of the Subscription Fee is not possible. A refund will be issued only related to the Training Fee and due to the circumstances elaborated below:

1. Cancellation by Training Provider

In the event of a cancellation by the Training Providers, Participants will receive a full refund of the Training Fee.

2. Cancellation by Participants

In the event Participants is unable to attend the training courses due to any reason, the refund policy shall be subject to the sole discretion of the respective Training Provider. Participants are advised to directly contact the Training Provider through the contact information provided by the Training Provider on the Site.

Please be advised that EKONID will implement a cancellation fee of 10% of the Training Fee paid (“Cancellation Fee”).

 

3. Communication between Training Providers and Participants

If you are a Participant, our Service allows you to register for training available on the Site. For any direct inquiries or questions related to the training, you are required to contact the Training Provider directly.

If you are a Training Provider, you may communicate with Participants through the contacts provided to you during registration. You bear sole responsibility for all communications with the Participants who receive your information through our Site.

 

4. External Links

The Site may include links to external Sites or content that is owned or operated by third parties, as well as features displayed in banners or other advertising formats. Please be advised that we do not investigate, monitor, or verify the accuracy, adequacy, validity, reliability, availability, or completeness of such external links.

 

We make no warranties, endorsements, or guarantees regarding the accuracy or reliability of any information provided by third-party sites linked through the Site, or by any site or feature displayed in banners or other advertisements. We shall not be liable for, nor assume any responsibility for, monitoring or managing transactions between you and third-party providers of products or services.    

5. Miscellaneous Legal Terms

These Terms constitute a formal contract and include important legal provisions designed to safeguard our interests and address various potential issues. These Terms define the legal relationship between EKONID and you, ensuring clarity and protection for both parties.

1. Binding Agreement

By registering, accessing, or using our Site, you acknowledge and agree that you are entering into a legally binding agreement with EKONID.

If you are a Training Provider, accepting these Terms and using our Site on behalf of a company, organization, government, or other legal entity, you affirm that you have the authority to do so.

These Terms, including any linked agreements and policies (such as the Training Provider Terms if you are a training provider), constitute the complete agreement between you and EKONID.

If any part of these Terms is determined to be invalid or unenforceable under the applicable law, that provision will be replaced with a valid and enforceable provision that closely aligns with the original intent. The rest of these Terms will remain in effect.

A delay in enforcing our rights or a failure to enforce them in a particular case does not constitute a waiver of those rights. We may choose to enforce them later. Similarly, if we waive any of our rights in a specific instance, it does not mean we waive those rights generally or in the future.

 

2. Disclaimers

Our Site may occasionally be unavailable due to planned maintenance or unforeseen issues. Additionally, Training Providers may provide content that could be misleading, and there may be security issues from time to time.

In legal terms, the training content is provided on an “as is” and “as available” basis. We make no guarantees regarding the suitability, reliability, availability, timeliness, security, accuracy, or error-free nature of the Services or Training Provider’s content. We expressly disclaim all warranties and conditions, whether express or implied, including but not limited to implied warranties of merchantability, for a particular purpose, title, and non-infringement.

We also have additional disclaimer as follows:

1. Site Usage Disclaimer

The Site is available to be used in an acceptable manner of usage, and unless you own the material thereon, you must not:

1. re-publish any material from our Site (including re-publication in other media);
2. sell or sub-license any material from our Site; or
3. re-distribute any material from our Site, both for commercial or non-commercial use.

We reserve the right to restrict access to parts of our Site, or the whole Site, at our discretion; you must not evade or bypass, or attempt to evade or bypass, any access restriction measures on our Site.

We reserve the right to terminate accounts and cancel bookings or orders in their sole discretion.

2. Professional Disclaimer

The Site contents do not constitute professional advice. Any content is provided for general information and educational purposes only. Accordingly, before taking any actions based upon such information, we encourage you to consult with appropriate professionals. The use of or reliance on any information contained in this Site is solely at your own risk.

3. Trademark Disclaimer

All contents, images and photos displayed on this Site are protected by copyright and may not be used, including but not limited to the amendment, circulation, copying and reproduction of such information, images and photos, without written permission of the author. The use of any information, images or photos of “Education Indonesia” copyright by any third party for commercial purposes is prohibited unless authorized by us in writing.

3. Indemnification

Participants and Training Providers agree to indemnify and hold harmless EKONID and its officers, employees, managers, directors, partners, members, agents, contractors, shareholders, affiliates, licensors, successors, and assigns from and against any and all costs, claims, losses, damages, liabilities, expenses, fees, demands, and judgements, including court costs and attorney’s fees, which may arise out of Training Providers/Participants violation of these Terms or use of any information obtained from the Site. 

4. Law and Jurisdiction

These Terms of use, their validity, interpretation, execution and the settlement of disputes shall be governed by the laws of the Republic of Indonesia.    

All disputes, disagreements and/or differences of opinions arising in connection with the contents and the implementation of these Terms shall first be resolved by amicable settlement.   

In the event that a settlement is not reached within 30 (thirty) days from the date one Party notifies the other Party in writing of its intention to submit the dispute, all disputes arising from these Terms of Use shall be finally settled by arbitration under the administrative and procedural applicable Rules of Badan Arbitrase Nasional Indonesia (BANI). The arbitration will be conducted in the English language in Jakarta, Indonesia. Arbitrations will consist of one arbitrator (“Arbitrator”) appointed in accordance with the procedures set out under the applicable Rules of BANI regarding the procedure of appointment of arbitrators.   

The decision of the Arbitrator in any matter will be final, binding, and inconstable and may be used as a basis for enforcement thereon in Indonesia or elsewhere.

 

5. Limitation of Liability

Any professional trainer can use the Site to publish training, and any User can register for the training provided.

EKONID shall not be liable for any claims, demands, actions, suits, obligations, losses, damages, liabilities, expenses or costs arising out of or relating to the Site, the Services, or your use of either. You assume full responsibility for the choices you make before, during, and after you access this Site.

EKONID only provides the Site as an online platform for Training Providers and Participants. We do not hire or employ trainers. In no event shall EKONID or its officers, employees, managers, directors, partners, members, agents, contractors, shareholders, affiliates, licensors, successors, or assigns have any liability to you for any direct, indirect, special, incidental, multiple, exemplary, punitive, or consequential damages, or for lost profits, loss of use, business interruption, costs of procurement of substitute goods or services, either in contract, tort or under any other theory of liability, whether or not the possibility of such damage has been advised to you. 

In no event shall EKONID’s maximum liability exceed the fees paid by the Training Provider and/or Participants, whether in contract, tort or under any other liability. 

6. Translations

As required under Indonesian Law No. 24 of 2009 on National Flag, Language and Coat of Arms as well as Anthem, this Terms is executed in English and Bahasa Indonesia. In the event of any inconsistency or conflict in interpretation between the two versions, the English version shall prevail, and the Bahasa Indonesia version will be amended solely to adjust for these inconsistencies.

 

6. Updating These Terms

From time to time, we may update these Terms to clarify our practices or to reflect new or different practices (such as when we add new features), and EKONID reserves the right in its sole discretion to modify and/or make changes to these Terms at any time. If we make any material change, we will notify you using prominent means, such as by email notice sent to the email address specified in your account or by posting a notice through our Site. Modifications will become effective on the day they are posted unless stated otherwise.

Your continued use of our Services after changes become effective shall mean that you accept those changes. Any revised Terms shall supersede all previous Terms.

 

7. Deleting Your Account

You may request the deletion of your account at any time by contacting us directly at admin@training-indonesia.org. Upon receiving your request, we will process the deletion in accordance with our internal procedures. Please note that account deletion is irreversible and will result in the loss of all associated data and access to our services.
